Federal Judge Blocks Rule Limiting Migrant Asylum

President’s administration immediately appealed to the 9th Circuit Court.

District Judge John Tigar blocked the new asylum policy of President Biden’s administration this week, ruling that it was illegal for the United States to bar certain migrants from seeking asylum. 

The president’s administration implemented the new rule after pandemic migrant restriction Title 42 expired on May 11. The rule prevents migrants from seeking asylum in the United States if they pass through other countries without seeking asylum there first. The American Civil Liberties Union (ACLU) challenged this ruling, saying that the law only applies if the countries they pass through are safe alternatives.

Judge Tigar ruled in favor of the ACLU in a 35-page decision. Within hours President Biden’s administration appealed that ruling to the 9th Circuit Court of Appeals, continuing to defend the policy.
